Personal Training Agreement and Terms of Service
1. Programs on Offer
- The personal trainer agrees to provide fitness training Programs to the client as outlined in the agreed upon package or sessions.
- By purchasing these programs you are agreeing to the Terms of Service.
2. Payment
- Payment for personal training Programs is due in advance and must be received before the commencement of each training session or time relating to programs provided.
- Late payment or missed sessions may be subject to additional fees or result in the suspension of training Programs.
- Online Programs are a direct debit model charged weekly.
- In person group sessions are a direct debit model charged weekly.

3. Cancellation/Refund Policy
- Clients are required to provide a minimum of 24 hours notice for in person 1 on 1 cancellations. Missed sessions without proper notice will be charged in full.
- Clients who have purchased the In person group sessions can attend up to 3 sessions a week, if sessions are missed, the client will still be charged the weekly rate.
- Clients who have purchased group sessions can cancel the weekly subscription at any time, please email customer care for further assistance.
- If a client does not show up for a scheduled session, the session will be considered a "no show" and will be charged at the full rate.
- If your trainer needs to cancel a session, you will be notified as soon as possible, and the session will be rescheduled without any additional charge.

4. Health and Medical Considerations
- Clients are responsible for informing the personal trainer of any health conditions, injuries, or concerns before the commencement of training.
- The personal trainer reserves the right to request a medical clearance from a physician or allied health professional before conducting business.
5. Confidentiality
- The personal trainer agrees to keep all client information confidential, including personal health information unless a referral to a physician or allied health professional is needed.
- When a referral is required due to special dietary requirements, poor health or physical health, you are consenting that your information can be shared to a physician or allied health professional.
- Information will be shared professionally with a physician or allied health professional if required.
6. Code of Conduct
- Both the personal trainer and the client agree to maintain a professional and respectful relationship during training sessions or interactions.
- The personal trainer agrees to maintain a neat and professional appearance, wearing appropriate fitness attire. The client is expected to wear suitable workout attire and maintain good personal hygiene during training sessions.
- The personal trainer commits to starting and ending sessions at the scheduled times. In the event of any unavoidable delays, the client will be informed in advance.
7. Liability Waiver
- Clients acknowledge the inherent risks associated with physical exercise and agree to release the personal trainer from any liability for injuries or damages that may occur during or after training sessions.
8. Termination of Services
- In case of violation of terms and conditions, the personal trainer reserves the right to conclude all dealings with the client.
- Non Payment If the client fails to make timely payments and such non-payment persists, the personal trainer reserves the right to conclude all dealings with the client.
- Failure to Follow Guidelines If the client consistently fails to adhere to the agreed upon training guidelines, safety protocols, or instructions provided by the personal trainer, termination may occur.
- Inappropriate Behaviour The personal trainer reserves the right to conclude all dealings with the client, if the client engages in inappropriate, disrespectful or threatening behaviour towards the personal trainer or other clients.
- Health and Safety Concerns If, in the professional judgment of the personal trainer, the client's health or safety is at risk during training sessions due to undisclosed health conditions or non compliance with safety recommendations, The personal trainer reserves the right to conclude all dealings with the client.
- Failure to Provide Required Information If the client fails to provide accurate and necessary health information or medical clearance, the personal trainer reserves the right to conclude all dealings to ensure the client's wellbeing.
9. Intellectual Property
- Any training programs, workout routines, or nutritional information provided by the personal trainer are for the client's personal use only and may not be shared or reproduced without permission.
10. Agreement Acceptance
- By engaging in personal training Programs, both parties acknowledge and agree to abide by the terms and conditions outlined in this agreement.
11. Changes to terms and conditions
- Powerful You Fitness can update these terms and conditions when required to and that continued use of the website or phone app means you agree to these terms. Only current clients using this platform will be notified of any changes to their existing terms and conditions as it may affect them.
